This website is operated by PackByPlace. Throughout the site, the terms “we”, “us” and “our” refer to PackByPlace (the business name for Tyree McLean). We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province or territory of residence. You represent and warrant that all information you provide is correct, current, and complete. You are solely responsible for maintaining the security of your account credentials and for all activities that occur under your account.

SECTION 2 - OUR PRODUCTS

We make every effort to provide an accurate representation of our products. However, please note that colors or product appearance may differ due to your device's display settings. All descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

SECTION 3 - ORDERS AND AVAILABILITY

When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm acceptance and process the transaction. PackByPlace reserves the right to accept or decline your order for any reason.

Availability: All orders are subject to product availability. In the event of a stock discrepancy or warehouse fulfillment delay, we reserve the right to cancel your order and provide a full refund. You represent that your purchases are for personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed. Unless otherwise expressly stated, posted prices do not include taxes (HST/GST), shipping, handling, or environmental fees. You represent that (i) the payment information you provide is true and complete, and (ii) you will pay all charges incurred at the posted prices, including applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

We are not liable for shipping delays caused by carriers, weather, or events outside our control. Title and risk of loss pass to you once we transfer the products to the shipping carrier.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, brand names, website content, and product designs, are owned by us, our licensors, or the respective manufacturers (including Randmar where applicable) and are protected by Canadian and international intellectual property laws. You must not reproduce, distribute, or modify any material from the Services without prior written consent.

SECTION 7 - RELATIONSHIP WITH SHOPIFY

PackByPlace is powered by Shopify Inc. However, your purchase is made directly with PackByPlace. You acknowledge that Shopify is not responsible for any aspect of the sales or transactions between you and PackByPlace.

SECTION 8 - WARRANTIES AND LIMITATION OF LIABILITY

PRODUCT WARRANTY: Products sold on this site are manufactured by third parties and are subject only to the manufacturer’s limited warranty included with the product. PackByPlace acts solely as the retailer. Any warranty claims regarding product defects should be directed to the respective manufacturer.

DISCLAIMER: EXCEPT AS EXPRESSLY STATED BY THE MANUFACTURER, PRODUCTS DELIVERED TO YOU ARE PROVIDED 'AS IS' AND 'AS AVAILABLE'. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL PackByPlace BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

NOTE TO QUEBEC CONSUMERS: The legislation of some provinces (including Quebec) may not allow the limitation of certain legal warranties or liabilities; therefore, some of the above exclusions may not apply to you.

SECTION 9 - GOVERNING LAW AND JURISDICTION

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes arising out of or regarding these Terms of Service shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario.
